1) Agreement to Terms

By accessing, browsing, or placing an order on www.physiofitlab.com (the “Website”), you agree to be bound by these Terms of Service (“Terms”) and all policies referenced here (Privacy Policy, Shipping Policy, Returns & Refunds Policy, Payment Policy, and Disclaimer). If you do not agree, do not use the Website.
These Terms form a contract between you and PhysioFitLab (“we,” “us,” or “our”).

6) Orders, Pricing, Taxes, and Availability

All orders are offers to purchase products subject to our acceptance. Prices, promotions, and availability may change without notice. Applicable taxes and duties are calculated at checkout or upon import (where relevant). We may refuse or cancel any order, including for suspected fraud, policy violations, or product unavailability.

7) Payments

• Accepted methods: PayPal, Visa, MasterCard, Google Pay, Apple Pay, Diners Club, Maestro, and Discover.

• Card, Apple Pay, and Google Pay transactions are securely processed via Shopify Payments. PayPal transactions are processed by PayPal.

Current service levels, cut-off times, carriers, and timelines are described in our Shipping Policy. Delivery estimates are not guarantees and may be impacted by factors outside our control (e.g., carrier delays, customs, weather).

9) Returns & Refunds

We offer returns consistent with our Returns & Refunds Policy. Please review eligibility, timelines, conditions, and how refunds are issued before initiating a return.

10) Permitted Use; Restrictions

We grant you a revocable, non-exclusive, non-transferable, limited license to access and use the Website for personal, lawful purposes. You may not:

• License, sell, rent, lease, assign, distribute, or commercially exploit the Website or any part of it.

• Modify, create derivative works of, reverse engineer, or attempt to extract source code from the Website.

By opting in at checkout or via our forms, you agree to receive recurring text messages (e.g., order updates, marketing). Message frequency varies. Consent is not a condition of purchase. Message/data rates may apply.

17) Limitation of Liability

To the fullest extent permitted by law, PhysioFitLab and its officers, employees, agents, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

18) Indemnification

You agree to indemnify and hold PhysioFitLab harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

19) Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules.

20) Dispute Resolution; Arbitration; Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be finally resolved by binding arbitration administered in India under applicable administered arbitration rules then in force.

  To the extent permitted by law, disputes will be resolved only on an individual basis; class, consolidated, or representative proceedings are not permitted. If a court determines the class-action waiver is unenforceable as to a particular claim, that claim must proceed in court—not in arbitration. Nothing in this section prevents either party from seeking provisional or injunctive relief in a court of competent jurisdiction.

21) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you violated these Terms or applicable law. You may stop using the Services at any time.

22) Severability; Entire Agreement; Assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with referenced policies, constitute the entire agreement between you and PhysioFitLab regarding the Services and supersede prior agreements on the subject. You may not assign these Terms without our prior written consent.
